User Agreement

TERMS OF USE

This document, the “Terms of Use” (hereinafter referred to as the “Agreement”), constitutes an offer by Sole Proprietor Oleg Zubkov, available on the website https://bimbobooks.ru (hereinafter referred to as the “Website”), to enter into an agreement on the terms set forth below.

1. GENERAL PROVISIONS

1.1. You hereby confirm that from the moment of registration on the Website and during your use of the Website, as well as its personalized services, you are a User of the Website until you personally contact the Website administration with a request to terminate any relationship with the Website.

1.2. Your use of the Website in any manner and form within its declared functionality, including:

a) Viewing materials posted on the Website;

b) Registration and/or authorization on the Website, including using the Sber ID service (functionality provided by Sberbank of Russia for transmitting user personal data for authentication and auto-filling user data on the Website);

c) Posting or displaying any materials on the Website, including but not limited to texts, hyperlinks, images, audio and video files, information, and/or other data

constitutes an agreement on the terms of this Agreement in accordance with the provisions of Articles 437 and 438 of the Russian Civil Code.

1.3. By using any of the above Website usage options, you confirm that:

a) You have read the terms of this Agreement in full before using the Website;

b) You accept all terms of this Agreement in full without any exceptions or limitations on your part and undertake to comply with them or cease using the Website. If you do not agree with the terms of this Agreement or are not entitled to enter into an agreement based on them, you should immediately cease any use of the Website;

c) The Agreement (including any of its parts) may be amended by the Website without any special notification. The new version of the Agreement comes into force from the moment of its posting on the Website or bringing to the User’s attention in any convenient form, unless otherwise provided by the new version of the Agreement.

2. GENERAL TERMS OF WEBSITE USE

2.1. The Website sells goods and/or services via the web resource https://bimbobooks.ru and its associated service functions.

2.2. The Website arranges delivery of goods using methods defined in Part 5 of this Agreement.

2.3. The Website provides access to personalized services to obtain comprehensive information about the goods of interest, create ratings and reviews, participate in contests and other promotions conducted by the Website.

2.4. You hereby give your voluntary consent to be informed about all Website activities related to the sale of goods and/or provision of services, including order status updates, as well as other events of any nature related to the Website’s services.

2.5. Consent to Receive Mailings:

By subscribing to SMS and email newsletters from https://bimbobooks.ru or third parties authorized to send newsletters on behalf of https://bimbobooks.ru on the internet, you agree to receive informational messages on the phone number and/or email address provided during subscription to the newsletter on the website https://bimbobooks.ru.

You are informed that to unsubscribe from the https://bimbobooks.ru newsletter, you will need to independently follow the “Unsubscribe” link provided in the messages sent by the Website from the Website’s email address https://bimbobooks.ru or communicate your disagreement to receive newsletters using the addresses specified in the “Contacts” section of this Agreement.

You also grant permission to the Website or third parties authorized to send newsletters on behalf of the Website to collect, store, and process all personal data provided to the Website (including surname, name, patronymic, and email address) for the purpose of informing about news and other Website events.

2.6. You agree that the Website shall not be held liable for any delays, failures, incorrect or untimely delivery, deletion, or loss of any notifications. The Website reserves the right to resend any notification if it is not received by you.

2.8. You acknowledge that the product descriptions on the Website do not claim to be exhaustively informative and may contain inaccuracies. You have the right to submit any remarks regarding inaccurate product descriptions to the Website at mp@arkol.ru.

2.9. You acknowledge that the Website makes reasonable efforts to ensure that the appearance, packaging, and characteristics of the goods correspond to the descriptions provided in the Website catalogue. At the same time, the Website informs you that the actual appearance, packaging, and characteristics of the goods may differ from these descriptions in the case of assortment items, as well as if changes are made to the product by the manufacturer directly.

2.10. You are informed that the price and availability of goods on the Website change around the clock without prior notice and are indicated in the individual status and detailed product card displayed in the Website catalogue.

3. USER OBLIGATIONS WHEN USING THE WEBSITE

3.1. You agree not to use the Website services for the following purposes:

3.1.1. Uploading content that is unlawful, infringes any third-party rights; promotes violence, cruelty, hatred, and/or discrimination based on racial, national, gender, religious, or social grounds; contains false information and/or insults directed at specific individuals, organisations, or government authorities;

3.1.2. Inciting unlawful actions and assisting individuals whose actions aim to violate restrictions and prohibitions in effect in the Russian Federation;

3.1.3. Violating the rights of minors and/or causing harm to them in any form;

3.1.4. Infringing the rights of minorities;

3.1.5. Impersonating another person or representing an organisation or community without sufficient rights, including posing as Website employees;

3.1.6. Misleading regarding the properties and characteristics of any products in the catalogue; making incorrect product comparisons, as well as forming negative attitudes towards individuals who (do not) use certain products, or condemning such individuals;

3.1.7. Uploading content that you are not authorised to make available under Russian law or any contractual relationships;

3.1.8. Uploading content that involves or contains any patent, trademark, trade secret, company name, copyrights, and related rights, as well as other rights to results of intellectual activity owned or lawfully used by third parties;

3.1.9. Uploading unauthorised advertising information and/or spam;

3.1.10. Collecting and processing personal data and information about the private life of any individuals;

3.1.11. Disrupting the normal operation of the Website;

3.1.12. Violating russian or international laws.

3.2. You agree not to use the Website for abusive language, obscene and offensive images, comparisons, and expressions, including those related to gender, race, nationality, profession, social category, age, language of a person and citizen, as well as in relation to organisations, government authorities, official state symbols (flags, coats of arms, anthems), religious symbols, cultural heritage objects (historical and cultural monuments).

3.3. You acknowledge and agree that the Website has the right (but not the obligation) to refuse to post and/or remove any content available through the Website services at its discretion.

4. PRIVACY POLICY

4.1. The terms of the Privacy Policy and the relationship between you and the Website regarding personal data processing are governed by the Data Protection Act (Federal Law No. 152-FZ of July 27, 2006, "On Personal Data").

4.2. The Privacy Policy applies to personal data that the Website receives or may receive from you during registration, including using the Sber ID service (functionality provided by Sberbank of Russia for transmitting user personal data for authentication and auto-filling user data on the Website) and/or placing an order on the Website, and necessary for fulfilling the Website’s obligations regarding the purchased product/service and/or your access to the Website services.

5. TERMS OF PURCHASE AND DELIVERY

5.1. You can purchase goods on the Website by paying using the following methods: bank card, payment to a bank account.

5.2. You hereby agree that the payment method you choose cannot be changed from the moment the order is placed on the Website.

5.3. You hereby agree that confirmation of an order paid by bank card or bank account occurs only after confirmation of funds deduction for order payment.

5.4. You confirm that payment of the order by bank card or bank account must be made within 2 calendar days from the moment of placing the order on the Website. You agree that if the order is not paid within the specified period, the order may be cancelled.

5.5. The Website provides the following delivery methods: courier delivery, delivery to a pick-up point. You have the right to choose any convenient delivery method in accordance with the delivery terms for your region/country or based on your preferences.

5.6. You agree that if it is impossible to transfer the goods to you due to your fault, including violation of the period within which you are obliged to pick up the goods, it will be considered by the Website as your refusal of the goods. In this case, the goods will be returned to the Website, and the order will be considered cancelled.

5.7. In case of your refusal of the goods, as well as in case of unavailability of the ordered goods, the prepayment for the goods transferred to the Website, excluding the Website’s delivery expenses, will be refunded to you within 10 calendar days.

6. LIABILITY

6.1 The Website services may contain links to other resources. You acknowledge and agree that the Website is not responsible for the availability of these resources and their content, as well as for any consequences related to your use of the content of these resources.

6.2 You also agree that the Website is not responsible for your personal data that you provide to third-party resources and/or other third parties when transitioning to them from the Website.

6.3 You confirm that the Website is not responsible for possible loss and/or damage to data that may occur due to your violation of the provisions of this Agreement, as well as improper access to and/or use of the Website’s personalised services.

6.4 Responsibility for the actions of minors, including the purchase of goods from the Website catalogue by them, lies with the legal representatives of minors.

6.5 You agree that in case of non-fulfillment and/or improper fulfillment by the Website of obligations regarding the sale and/or delivery of goods to you due to the provision of false and/or invalid data about yourself, as well as non-fulfillment of the terms of this Agreement by you, the Website will not be held liable.
